Sandblasting firm accused of failing to pay overtime

BECKLEY — The acting secretary of labor has filed a complaint against Superior Steam Cleaning and Sandblasting and company owner Douglas Humphrey, citing alleged violation of federal workers compensation law.

Edward C. Hugler filed a complaint March 1 in the U.S. District Court for the Southern District of West Virginia against the defendants, alleging that they violated the provisions of Sections 7 and 15(a)(2) of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Nov. 4, 2012, and Oct. 25, 2015, the defendants willfully and repeatedly violated the act by employing employees for workweeks longer than 40 hours without compensating them for overtime rates of not less than one and one-half times their regular rates. The plaintiff holds Superior Steam Cleaning and Sandblasting and Humphrey responsible because the defendants allegedly failed to pay the total amount of back wage compensation found by the court to be due their former or current employees.

The plaintiff requests a trial by jury and seeks judgment for unpaid overtime compensation due their employees, plus liquidated damages and other relief. He is represented by Gary Call of the U.S. Department of Labor in Charleston.
