Car buyers sue Ford, alleging warranty violation

Contract 03

PINEVILLE — Two consumers are suing Ford Motor Co., alleging a breach of implied and express warranties after purchasing a Ford Focus in 2014.

Anthony Lester and Tiffany Sweetser filed a complaint on March 2 in the Wyoming Circuit Court against Ford, alleging that the automobile manufacturer failed to comply with the New Motor Vehicle Warranties Act of West Virginia.

According to the complaint, Lester and Sweetser purchased a 2014 Ford Focus for $23,446.92 on June 7, 2014. Since the purchase, the plaintiffs experienced problems with the vehicle, such as sharp shuttering, that will likely cause serious injuries if the vehicle is driven, the complaint said. The plaintiffs hold Ford responsible because the defendant allegedly failed to adequately repair the vehicle to bring it in conformity with its warranties and refused to revoke the acceptance of the vehicle and to refund plaintiffs' purchase price.

The plaintiffs request a trial by jury and seek proper rejection of the vehicle or revocation of acceptance, award for damages, attorney fees, costs and other relief. They are represented by Anthony H. Heltzel of Heltzel Law Office PLLC in Beaver.
