Woman sues Manpower of WV for failure to accommodate, wrongful termination

CHARLESTON – A Cabell County woman is suing Manpower of WV Inc. after she claims she was wrongfully terminated from her employment after requesting accommodation for her medical condition.

A.C.Z. Incorporated was also named as a defendant in the suit.

Priscilla L. Gray worked for the defendants for nearly 21 years until her employment was terminated on May 11, according to a complaint filed March 15 in Kanawha Circuit Court.

Gray claims at the time of her termination, she was the district manager and oversaw three staffing officers in Huntington; Ashland, Ky.; and Prestonsburg, Ky.

During the plaintiff’s entire tenure with the defendants, she had never been disciplined or ever placed on an improvement plan, according to the suit, and, at all times, she had performed her duties in a satisfactory manner and met the reasonable expectation of the defendants.

Gray claims in August 2015, the defendants created a hostile work environment for her that continued until her termination.

The hostile work environment stemmed from Gray engaging in protected acts in furtherance of substantial public policy of West Virginia and her request for an accommodation protected by the West Virginia Human Rights Act, according to the suit.

Gray claims she sent an e-mail on May 11 to a representative of the defendants’ national office, expressing concern over the hostile work environment and violations of law. She was informed later that day that her employment was terminated.

The defendants failed to accommodate Gray’s medical conditions when she requested accommodations, which violates the West Virginia Human Rights Act, according to the suit.

Gray is seeking compensatory and punitive damages. She is being represented by Michael L. Glasser

The case is assigned to Circuit Judge James C. Stucky.
