Auto repair shop operators blamed for death

LOGAN — A Logan County man is suing Man auto repair shop operators, alleging their negligence led to an auto crash fatality. 

Samuel Lee Smith, as personal representative of the estate of Brooke Ann Lusk, filed a complaint March 8 in Logan Circuit Court against The Junction Motorsports LLC and Keith Gamble, alleging failure to test and confirm the functionality of the components of a customer's ATV.

According to the complaint, on May 30, 2016, Smith was operating his ATV with Brooke Ann Lusk when the rear wheels suddenly locked up, causing the vehicle to roll over and forcefully eject both riders. 

The suit says both sustained violent impacts upon the asphalt, causing severe injuries to Smith and fatal injuries to Lusk, who suffered fractures to her face and skull, and died March 31, 2016. The plaintiff alleges he suffered loss of service of his live-in partner. 

The plaintiff alleges the defendants failed to provide adequately trained and skilled workers to perform repairs and maintenance work on the ATV.

Smith seeks trial by jury, compensatory and punitive damages in an amount adequate to punish the defendants, interest, costs and all other just and proper relief. He is represented by attorneys P.
