North Carolina financial business alleges borrower, guarantors owe nearly $90,000

BECKLEY — A North Carolina financial corporation is suing a borrower and guarantors, alleging breach of a loan and guaranty agreement.

Branch Banking and Trust Company filed a complaint in Raleigh Circuit Court against Richmond Optics Inc. Kathi L. Holley, Barni G. Richmond and Homer Richmond, alleging they have defaulted their obligations.

According to the complaint, on June 2, 2010, Brank Banking provided a loan to Richmond Optics of $114,100.73. Holley and Barni Richmond, the suit says, guaranteed payment for the loan. 

As of Feb. 21, the total balance of $88,587.97, remains due and owing, the lawsuit states. The plaintiff alleges the defendants have failed to make payments for the due amount.

Branch Banking and Trust seeks trial by jury, judgment, jointly and severally, for $88,587.97, interest, court fees and costs and all other appropriate relief. It is represented by attorneys James W. Lane Jr., Bradford P. Bury and Jason A. Proctor of Flaherty Sensabaugh Bonasso PLLC in Charleston.
