Kentucky corporation alleges debtor, guarantor owe more than $21,000

FAYETTEVILLE — A Kentucky corporation is suing a debtor and guarantor, alleging breach of an agreement.

Brown Food Service Inc. of Louise, Kentucky, filed a complaint March 15 in Fayette Circuit Court against Dirty Ernie's Rib Pit Inc. and Michael Price, alleging they failed to perform their obligations under an agreement.

According to the complaint, in 2012 at the request of Dirty Ernie's Rib Pit, Brown Food Service delivered certain goods and merchandise at a reasonable amount. As of Dec. 8, 2016, the suit says, the balance pf $15,335.40 remains due and owing. 

The plaintiff alleges the defendants willfully failed and refused to pay the balance, plus interest, attorney fees and collection costs.

Brown Food Service seeks trial by jury, payment of $21,117.53, plus continuing interest and court costs. It is represented by attorney Arch W. Riley, Jr. of Bernstein-Burkley PC in Wheeling.
