Nurse's aid accuses accuses former employer of wrongful termination

HUNTINGTON — A nurse's aid is suing a Huntington medical center, alleging age discrimination, wrongful termination and failure to pay final wages.

Joseph Wolowinski filed a complaint March 16 in Cabell Circuit Court against St. Mary's Medial Center Inc. and Paul Laugaman, alleging they violated the Wage Payment and Collection Act and the West Virginia Human Rights Act.

According to the complaint, as a result of defendant's actions, Wolowinski, who began working for St. Mary's in 1989,  has suffered humiliation, embarrassment, indignity and emotional distress. He alleges he was unlawfully terminated May 17, 2016. 

The plaintiff alleges the defendants subjected him to discrimination because of his age (60), harassment, retaliation and termination for actively supporting the labor union and failure to timely pay his final wages on the next scheduled payday as required by law.

Wolowinski seeks trial by jury, compensatory and punitive damages, attorney fees, legal costs and interest and all other just and proper relief. He is represented by attorney D. Adrian Hoosier II of Lord Hoosier PLLC in Charleston.
