Customer blames Polaris for substandard vehicle

LOGAN — A Logan County customer is suing the Polaris auto manufacturer, alleging breach of warranty.

Samuel Tipton II of Blair filed a complaint March 16 in Logan Circuit Court against Polaris Industries Inc. alleging failure to comply with Lemon Law provisions.

According to the complaint, on Nov. 8, 2016, Tipton purchased a new 2016 Polaris Razor XP Turbo for $24,999. Since the purchase, the suit says, Tipton has experienced repeated non-conformities with the vehicle, impairing its use, value and safety. 

The plaintiff alleges Polaris failed to repair the vehicle to conform it with the warranties.

Tipton seeks trial by jury, revocation of acceptance and refund of the purchase price, costs of repairs, loss of use, attorney fees, legal costs and all other relief. He is represented by attorney Steven S. Wolfe of Wolfe, White & Associates in Logan.
