PINEVILLE — A Wyoming County man is suing three Charleston companies, alleging their negligence caused him injuries.
Billy Joe Acord filed a complaint April 7 in Wyoming Circuit Court against Black Castle Mining Company LLC, Spartan Mining Company LLC, doing business as Trace Transportation Company, and Maxxim Shared Services LLC, alleging they violated the well-known industry standards and other safety laws and an unsafe workplace.
According to the complaint, on April 21, 2015, as Acord was attempting to operate an electric standup fork lift when it erratically turned and pinned the plaintiff's left foot against a pole. The suit says Acord sustained severe injuries to his left foot that required surgical and partial amputation.
The lawsuit states Acord has suffered extreme physical and mental pain, lost wages and medical expenses. The plaintiff alleges the defendants failed to provide a reasonably safe working environment and failed to provide proper and adequate training on how to operate the electric standup fork lift.
Acord seeks trial by jury, compensatory damages, court costs and attorney fees, pre- and post-judgment interest and all other appropriate relief. He is represented by attorneys D. Balke Carter Jr., J Ryan Stewart and Taylor M. Norman of Bailey Javins & Carter LC in Charleston.
