Customer accuses Fiat Chrysler of breaching warranty

WAYNE — A Wayne County customer is suing Fiat Chrysler, alleging breach of implied warranty.

Charles A. Tooley filed a complaint April 14 in Wayne Circuit Court against FIAT Chrysler Automobiles, also known as a FCA US LLC, alleging failure to provide the service and performance of its products as expected by consumers.

According to the complaint, on Aug. 20, 2016, Tooley purchased a new Chrysler Jeep Grand Cherokee from the defendant. On Oct. 9, 2016, however, the suit says the plaintiff experienced a severe and life-threatening malfunction of the transmission of the Grand Cherokee and returned it to the defendant's authorized dealer for repair. 

After the initial repair, the lawsuit states, the vehicle has continued to be out of conformity and further problems have arisen. 

The plaintiff alleges Fiat Chrysler has failed to correct the various problems of the vehicle even after numerous repairs and failed to disclose information concerning goods or services with the intention to induce consumer into buying the product.

Tooley seeks trial by jury, refund of all amounts paid toward the purchase of the Grand Cherokee, attorney fees, costs herein and all other appropriate relief. He is represented by attorney Charles C. Amos of Barrett, Chafin, Lowry and Amos in Huntington.
