Fayette Co. business blames automaker, dealer for car fire

BECKLEY — A Fayette County corporation is suing an auto manufacturer and distributor, alleging breach of warranty, negligence and strict liability.

Lee-Rocha Ltd. filed a complaint May 2 in Raleigh Circuit Court against FCA US LLC and Ramey Automotive, alleging they obtained profit through unfair or deceptive trade or commerce.

According to the complaint, on Dec. 29, 2015, Lee-Rocha suffered fire damages from a 2011 Dodge Ram pickup truck that was purchased from the defendants, as a result of the defendants' negligence to properly identify and notify the plaintiff of the recall of such defective vehicles. 

The suit says Lee-Rocha sustained loss of property and was exposed to harm when the vehicle was destroyed by fire that originated in the Dodge Ram's engine compartment under normal use and conditions. 

The plaintiff alleges the defendants failed to notify Lee-Roche of notices of defects and recall, and introduced a defective product into the stream of commerce. The suit says the plaintiffs suffered a loss of $20,026, aggravation, annoyance and inconvenience.

Lee-Roche seeks trial by jury, judgment against the defendants, damages, interest, attorney fees, court costs and and other just relief. It is represented by attorney Derrick W. Lefler of Princeton.
