Properties owner blames apartment operators for fire damages

FAYETTEVILLE — A Kanawha County woman is suing apartment operators, alleging their negligence led to a fire. 

Barabra G. Derrick filed a complaint May 3 in Fayette Circuit Court against Falbo Real Estate, John M. Falbo and Albert Thomas Falbo, alleging they breached their duty to maintain and keep their apartment building in a safe and secure manner.

According to the complaint, on May 10, 2015, buildings in Montgomery owned by Derrick were either destroyed or damaged due to a fire. The suit says the Montgomery Fire Department's investigation report concluded the fire originated from the defendants' property. 

Derrick says she suffered the loss of value of personal and real estate property. The plaintiff alleges the defendants failed to properly inspect, maintain and repair their property.

Derrick seeks trial by jury, damages for her personal and real property, pre- and post-judgment interest, costs and expenses of suit and all other just and proper relief.
