Relative blames care center for patient's death

CHARLESTON — A family member is suing a Kanawha County nursing home, alleging negligence led to the death of a resident.

Earl K. Burgess, as administrator of the estate of Johnny Ray Burgess, filed a complaint May 16 in Kanawha Circuit Court against 302 Cedar Ridge Road Operations LLC, doing business as Cedar Ridge Center, alleging failure to to provide proper care to Johnny Ray Burgess.

According to the complaint, Johnny Ray Burgess, who entered Cedar Ridge Center on Feb. 12, 2012, suffered serious physical injuries which resulted in his death April 11, 2015.. The plaintiff alleges Cedar Ridge Center failed to properly diagnose and treat Burgess' condition.

Earl Burgess seeks trial by jury, compensatory damages, all legal fees and all other relief the court deems just. He is represented by attorney Michael J. Del Giudice of Ciccarello, Del Giudice & Lafon in Charleston.
