Financing company accuses Hanover Wrecker of wrongful detention of property
PINEVILLE — A financing company is suing Hanover Wrecker, a towing company, citing alleged wrongful detention of property.
Ally Financial Inc, f/k/a GMAC filed a complaint on May 11, in the Wyoming Circuit Court against Hanover Wrecker alleging that the towing company failed to provide timely notice that it was retaining the vehicle and charging storage as required by law.
According to the complaint, the plaintiff alleges that, in Aug. 10, 2015, defendant towed a vehicle to its storage lot for an unknown reason. Plaintiff hold security interest over the vehicle and was irreparably harmed for the vehicle's continued depreciation. The plaintiff holds Hanover Wrecker responsible because the defendant allegedly refused to surrender possession the vehicle to which plaintiff holds first priority lien.
The plaintiff requests a trial by jury and seeks an order declaring that plaintiff has priority lien over the vehicle, immediate possession of the subject vehicle, award for damages equal to the amount of depreciation, costs for this action and such other relief as plaintiff may be entitled.
