Woman alleges West Virginia Division of Corrections failed to prevent abuse

KANAWHA — A West Virginia woman is suing a corrections facility and its employees, citing alleged negligence and violation of civil rights.

The plaintiff filed a complaint June 8 in the Kanawha Circuit Court against David Martin, individually and in his official capacity as a correctional officer of the West Virginia Division of Corrections; the West Virginia Division of Corrections; and John Doe, alleging they allowed their employee to sexually abuse the plaintiff.

According to the complaint, the plaintiff alleges that she suffered damages from experiencing abuse while in the corrections facility. The plaintiff holds the defendants responsible because they allegedly failed to protect the plaintiff from their employees.

The plaintiff requests a trial by jury and seeks damages, compensatory damages, punitive damages, all legal fees, and any other relief as this court deems just.
