WILLIAMSON — Two Mingo County property owners are suing telecom companies and and a power line operator, alleging trespassing and unjust enrichment.
Dallas T. Runyon Sr. and David E. Runyon filed a complaint June 16 in Mingo Circuit Court against Frontier Communications of West Virginia, Frontier West Virginia and Appalachian Power Company, alleging they intentionally entered the plaintiffs' Delbarton property without consent.
According to the complaint, the Runyons were denied their rights to develop their property and to enter into a lucrative timbering agreement. They say they suffered loss of revenues associated with the use of their property.
The plaintiffs allege the defendants improperly maintained and stored communications and power lines on the Runyons' property.
The Runyons seek trial by jury, compensatory, punitive and actual damages, disgorgement of profits and restitution, attorney fees, court costs and interest and all other legal and equitable relief.
