HG Energy, Ascent Resources-Marcellus accused of improperly calculating royalties

NEW MARTINSVILLE – A nonprofit organization alleges it was provided confusing and misleading royalty statements and that the royalties due to it were improperly calculated.

The Hoyt Foundation filed a complaint on June 26 in Wetzel Circuit Court against HG Energy LLC and Ascent Resources-Marcellus LLC, formerly known as American Energy-Marcellus LLC, alleging breach of contract.

According to the complaint, the plaintiff owns real property in Wetzel County and that the defendants have held or presently hold interests as lessees to the oil and gas rights.

The plaintiff holds HG Energy LLC and Ascent Resources-Marcellus LLC responsible because the defendants allegedly failed to properly calculate the royalties due to the plaintiff for the gas extracted from the property.

The plaintiff seeks a full and complete accounting of all gas produced from the property, all amounts received by the defendant and all royalties due and payable to the plaintiff. It is represented by Arch W. Riley Jr. of Bernstein-Burkley P.C. in Wheeling and by Travis A. Knobbe of the same firm in Pittsburgh. The case has been assigned to Circuit Judge Jeffrey Cramer.
