Oil, gas rights owner alleges successor lessee

NEW MARTINSVILLE — An oil and gas rights owner is suing a Texas company, alleging breach of lease agreement.

Daniel Bezilla filed a complaint June 28 in Wetzel Circuit Court against Tug Hill Operating LLC of Fort Worth, alleging the defendant breached the implied duty of continuous development.

According to the complaint, Bezilla has been damaged for not receiving royalty payments on his leased property in Wetzel County. The plaintiff alleges Tug Hill Operating failed to develop the property to produce sufficient oil and gas, failed to pay the royalty amount to Bezilla on a monthly basis and did not restore the land to as near its original condition.

Bezilla seeks trial by jury, declaration the lease is terminated or expired, prohibiting the defendant from entering the property, compensatory damages of $3.08 million and punitive damages of $240,000 and all other equitable relief. He is represented by attorney Kyle Nuttall of Nuttall Legal LLC in Buckhannon.
