CHARLESTON – A former employee of a Charleston business alleges he was injured on the job by another employee and unlawfully terminated him.

Barry Plumley filed a complaint on June 30 in the Kanawha Circuit Court against Steve & Stacy BP Service Inc. alleging deliberate intent and violation of the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that he was injured by another employee while employed by the defendant. He alleges this employee had a history of constantly harassing him and that the defendant failed to take proper precautions to ensure the safety of its employees.

The plaintiff also alleges that the defendant terminated him because of his age and disability.

The plaintiff requests a trial by jury and seeks punitive damages, interest, damages, all legal fees, lost wages and any other relief as the court deems just. He is represented by D. Adrian Hoosier and Erica Lord of Lord Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
