NEW MARTINSVILLE – A Wetzel County couple alleges that they have been damaged because of false and negative reporting on their credit reports.
Anthony R. Thomas and Erica D. Thomas filed a complaint on June 29 in Wetzel Circuit Court against Nationstar Mortgage LLC, Fortress Investment Group and John Doe alleging defamation and violation of the Fair Debt Collection Practice Act, the Home Mortgage Disclosure Act and the Equal Credit Opportunity Act.
According to the complaint, the plaintiffs sold their Paden City home in September 2015 and provided a payoff payment to Nationstar Mortgage in the amount of $53,281.25.
The plaintiffs hold Nationstar Mortgage LLC, Fortress Investment Group and John Doe responsible because the defendants allegedly refused to acknowledge the plaintiff's payment and refused to return the check. The plaintiffs allege that the defendants have falsely reported that the plaintiffs are in default of their loan and have damaged their character and reputation.
The plaintiffs request a trial by jury and seek all damages and interest. They are represented by Kevin L. Neiswonger of Neiswonger and White in Moundsville. The case has been assigned to Circuit Judge Jeffrey Cramer.
