Consumer claims Portfolio Recovery Associates harassed her with calls

POINT PLEASANT – A Mason consumer claims that a Virginia-based debt collector is using harassing and abuse collection practices.

Rhonda Chapman filed a complaint on July 3 in the Mason Circuit Court against Portfolio Recovery Associates LLC citing the Collection Agency Act and the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that the defendant called her multiple times a day and damaged her credit report by reporting the allegedly delinquent account to reporting agencies.

The plaintiff holds Portfolio Recovery Associates LLC responsible because the defendant allegedly engaged in abusive and misleading debt collection practices and invaded the plaintiff's home and privacy.

The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages, punitive damages, interest, attorney's fees and all further relief as the court deems appropriate. She is represented by Troy N. Giatras and Matthew Stonestreet of The Giatras Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Richard Craig Tatterson.
