MOUNDSVILLE – A Georgia man has filed a suit against a West Virginia resident and a Wheeling-based company after he was allegedly injured in a collision in Marshall County.
Bobby L. Jones filed a complaint on July 7 in the Marshall Circuit Court against Roger Klinger and Tri-State Petroleum Corp. alleging negligence.
According to the complaint, the plaintiff alleges that on July 8, 2015, he was lawfully operating his pickup truck when defendant Klinger, who was operating a tractor-trailer owned by his employer defendant Tri-State, negligently collided with his vehicle on Route 2 in Marshall County. The plaintiff alleges he sustained injuries to his head, neck, back and other parts of his body and was caused to incur medical expenses, disability, loss of ability to enjoy life and total loss of his vehicle.
The plaintiff holds Klinger and Tri-State Petroleum Corp. responsible because defendant Klinger allegedly failed to obey a traffic control device and failed to yield right of way.
The plaintiff requests a trial by jury and seeks compensatory damages, plus interest and all other relief as the court may find just and proper. He is represented by Jacob M. Robinson and Adam M. Hanasky of Robinson Law Offices in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
