C.B.S. Industrial Tooling alleges it is still owed more than $8,000 from Ohio couple

PRINCETON – A Princeton company that sells industrial machinery and equipment alleges that an Ohio couple has failed to pay for goods in full.

C.B.S. Industrial Tooling LLC filed a complaint on July 7 in the Mercer Circuit Court against doing business as Phoenix Hydraulics & Controls alleging breach of contract.

According to the complaint, the plaintiff alleges that between Nov. 9, 2010, and April 14, 2013, plaintiff provided goods to defendants for the total amount of $22,861.44. After crediting payments made by defendants, the balance of $8,909.25 allegedly remains due and owing. 

The plaintiff holds Michael N. Wheeler and Cheryl Wheeler, individually and doing business as Phoenix Hydraulics & Controls, responsible because the defendants allegedly failed and refused to make payments for the remaining balance herein mentioned.

The plaintiff requests a trial by jury and seeks damages in the amount of $8,909.25, plus interest and all further relief that the court deems proper. It is represented by Jerad K. Horne of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield. The case has been assigned to Circuit Judge William J. Sadler.
