MOUNDSVILLE – A Benwood couple is seeking underinsured motorist benefits from their insurer.
Marcia Buchner and Joseph Buchner filed a complaint July 18 in Marshall Circuit Court against Progressive Max Insurance Co. alleging negligence.
According to the complaint, Maria Buchner was injured in a collision with an underinsured motorist in 2010 who failed to yield to the right of way. They allege that the defendant knew there was underinsured exposure and failed to make any offers to settle plaintiffs' underinsured motorist claim.
The plaintiffs request a trial by jury and seek compensatory damages, plus interest, costs and all other relief as the court may find necessary. They are represented by Ronald W. Zavolta and Jordan M. Laird of Zavolta Law Office in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
