Motorist alleges she was injured in collision with Fayette County Commission vehicle

Car accident 01

FAYETTE – An Oak Hill woman alleges she was injured in a collision with a vehicle owned by the Fayette County Commission.

Tiffany Cook filed a complaint July 14 in Fayette Circuit Court against Carey A. Vickers, individually and as an employee of the Fayette County Commission, and The Fayette County Commission alleging negligence.

According to the complaint, the plaintiff alleges that on July 31, 2015, she was traveling on Summerlee Road in Oak Hill and stopped to avoid hitting a dog in the road. The suit states that Vickers, who was operating a Fayette County Commission van, struck the plaintiff's vehicle.

The plaintiff holds Vickers, individually and as an employee of the Fayette County Commission, and The Fayette County Commission responsible because Vickers allegedly failed to maintain control of the vehicle.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, interest, all legal fees, and any other relief as the court deems just. She is represented by Stephen P. New and Stacey L. Fragile of Law Office of Stephen P. New in Beckley. The case has been assigned to Circuit Judge John W. Hatcher Jr.
