Man alleges Smith & Nephew Inc. implant is defective

HUNTINGTON – A Cabell County man alleges he was injured by a defective medical implant.

Robert Kosa filed a complaint July 21 in Cabell Circuit Court against Smith & Nephew Inc. alleging negligence.

According to the complaint, the defendant manufactures a 10H Right plate that was implanted into the plaintiff. He alleges he has been damaged by the device.

The plaintiff holds Smith & Nephew Inc. responsible because the defendant allegedly failed to include proper warnings and instructions about the device and that the defendant did not properly conceive, design, research or study the device.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, interest, court costs and any further relief the court grants. He is represented by Marvin W. Masters of The Masters Law Firm LC in Charleston. The case has been assigned to Circuit Judge Paul T. Farrell.
