Motorist accuses United Services Automobile Association of breach of contract with claim

CHARLESTON – A Kanawha County woman alleges that her insurer has failed to pay her the reasonable value of her underinsured motorist claim.

Aconda C. Bevino filed a complaint on July 13 in the Kanawha Circuit Court against United Services Automobile Association alleging breach of contract for underinsured motorist benefits and other counts.

According to the complaint, the plaintiff alleges that she sustained injuries and damages to her vehicle as the result of an accident in July 2015 caused by a negligent driver. The suit states that the plaintiff settled with the driver and his liability insurer and asserted a claim for underinsured motorist benefits with the defendant. She alleges that the defendant has refused to pay her the reasonable value of her claim for personal injuries.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory and punitive damages, interest and court costs. She is represented by David M. Adkins of The Adkins Law Firm PLLC in Hurricane. The case has been assigned to Circuit Judge Carrie L. Webster.
