Consol equipment operator alleges he was injured when ladder failed on truck

WILLIAMSON – A Wayne County man alleges he was injured on the job because of a defective access ladder on his mining truck.

Jess W. Feltner Jr. filed a complaint July 31 in Mingo Circuit Court against Consol of Kentucky Inc. and Consol Energy Inc. alleging deliberate intent and negligence.

According to the complaint, the plaintiff alleges that on Aug. 4, 2015, he was climbing a ladder into his mining truck and the second step failed, causing him to injure his right harm when he caught himself.

The plaintiff holds Consol of Kentucky Inc. and Consol Energy Inc. responsible because the defendants allegedly failed to properly maintain and repair the truck.

The plaintiff requests a trial by jury and seeks damages in excess of the minimum requirements of the court, pre- and post-judgment interest, attorney's fees, costs and such other relief as the court deems just and proper. He is represented by Robert B. Warner, Lynnette Simon Marshall and Andrew D. Byrd of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Miki Thompson.
