CHARLESTON - A man is suing the West Virginia Department of Transportation-Division of Highways after he claims one of its employees caused a collision.
On July 5, 2011, James M. Copley was the operator of a motor vehicle traveling eastbound on W.Va. 47 in Parkersburg when a vehicle driven by Caleb Bourgeois and owned by the defendant caused a collision, according to a complaint filed May 15 in Kanawha Circuit Court.
Copley claims Bourgeois turned across his lane of travel while attempting to make a left turn and Copley was unable to avoid striking Bourgeois' vehicle, and, as a result, there was a collision.
As a result of the collision, Copley's vehicle was turned onto its side and he sustained injuries, according to the suit.
Copley claims the WVDOT is legally responsible for the negligent actions of Bourgeois because he was operating a WVDOT vehicle at the time of the accident.
As a result of the defendant's wrongful conduct, Copley suffered and incurred medical expenses; pain and suffering; physical limitations; diminished capacity to enjoy life; annoyance and inconvenience; other economic loss; and other consequences and damages associated with his injuries, according to the suit.
Copley is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Robert D. Cline Jr., Robert A. Campbell and Letisha R. Bika of Farmer, Cline & Campbell PLLC.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
