Man blames CAMC for woman's brain injury

CHARLESTON - A man is suing Charleston Area Medical Center after he claims it is responsible for a woman's brain injury.

Jarrin Raye Ball was a patient of CAMC from March 12, 2012, through April 6, 2012, according to a complaint filed July 3 in Kanawha Circuit Court.

Harold M. Miller, Ball's guardian and/or conservator, claims CAMC negligently failed to diagnose Ball's condition and injuries on March 22, 2012, and March 23, 2012, and failed to provide the level of care required by West Virginia code.

As a result of the defendant's negligent and careless acts and omissions, Ball suffered a serious brain injury and consequential damages and suffered permanent injuries, according to the suit.

Miller claims Ball sustained physical pain and suffering; emotional distress; disfigurement; diminution in earning capacity and lost wages; loss of ability to enjoy life; dependent care; medical expenses; and other damages.

The defendant's conduct amounts to gross negligence and/or was extremely negligent or reckless, according to the suit.

Miller is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Marvin W. Masters and Charles M. Love IV of the Masters Law Firm LC.

The case has been assigned to Circuit Judge Carrie Webster.
