Assistant Kanawha prosecutor seeks info on Topix commenters

CHARLESTON - An assistant Kanawha County prosecutor is alleging she was defamed by comments made about her on an Internet messaging board.

Erica N. Lord, 36 and of Charleston, seeks a court order compelling Topix, the Palo Alto, Calif.-based community news website, to reveal the Internet service provider addresses of seven people who posted negative comments about her.

Her complaint filed Oct. 1 in Kanawha Circuit Court names John Does 1-7 as co-defendants.

In it, she alleges the seven John Does on Sept. 27 posted “false, defamatory and untruthful information” about her on Topix “in an intentional and malicious effort to harm” her. Though she provides no specifics as to what the anonymous posters said, Lord says their comments caused her “to suffer severe emotional distress.”

Upon their identities being made public, Lord asks judgment be entered against them for all damages she’s suffered, recovery of interest, attorneys fees and court costs. She is represented by Charleston attorney C. Benjamin Salango, who is the husband of fellow Assistant Prosecutor Tera Salango.

According to the Kanawha County Commission’s Web site, Lord’s current salary is $41,596.25

The case is assigned to Judge Charles E. King, Jr.
