HUNTINGTON – A lawsuit against Wal-mart for an Achilles’ tendon injury has been dismissed from federal court. The lawsuit was dismissed on Jan. 12 by District Judge Robert C. Chambers after the plaintiff, Jennifer Bradshaw, and Wal-mart resolved all issues involved in the complaint and moved to have the lawsuit dismissed. The lawsuit was dismissed with prejudice.

CHARLESTON – A suit in which a man blames Wal-Mart, PepsiCo and Frito-Lay for injuries after an incident involving an in-store display of chips and salsa is headed to federal court. On Feb. 2, 2013, Arthur Buckalew was a patron lawfully walking along the premises near inside fixture displays of various merchandise, including Tostito’s corn chips and salsa, according to a complaint filed Jan. 27 in Kanawha Circuit Court. Wal-Mart filed to have it removed to federal court on Feb. 29.

HUNTINGTON – A lawsuit against Wal-Mart Stores Inc. for injuries sustained in a parking lot has been removed to federal court. The notice of removal states that the plaintiffs and the defendant are citizens of different states and, although the plaintiffs did not specifically please an amount of damages, it is "facially apparent" from the complaint that the plaintiffs seek damages in excess of $75,000, according to the Nov. 9 notice of removal, which was filed in the U.S.

CLARKSBURG – A Preston County country club says a racial harassment and discrimination lawsuit against it should be dismissed. Preston County Country Club filed a motion last week to have a civil lawsuit filed against it by Jason Goines removed to federal court.
