Couple seek $350K in royalty payments over Wayne Co. natural gas well

HUNTINGTON - A couple are suing, claiming they have not been fully compensated for a business investment.

Wallace L. Scruggs and Renee Scruggs filed a lawsuit Nov. 27 in the United States District Court Southern Division of West Virginia Huntington Division against Wayne Anderson and US Natural Gas Corp. WV.

According to the complaint, the defendants work to find investors to develop oil and gas wells. The plaintiffs were allegedly approached in early 2006 about construction of a natural gas well in Wayne County.

The Scruggses then paid $350,000 for 70 percent of the ownership of the well on Feb. 14, 2006, which was then constructed in 2010. To date, the Scruggs have received only one royalty payment in the amount of $141.07, according to the complaint.

The plaintiffs are suing for negligence, fraud and breach of fiduciary duty, stating they have not received the full amount owed to them under the terms of the ownership contract.

The Scruggses are seeking damages in the amount of $350,000. They are being represented in the case by attorney Robert R. Waters, of Waters Law Group PLLC.
