Lawsuit seeks more than $81K from used car dealer

FAYETTEVILLE - A man is suing after a company allegedly failed to deliver equipment contracted and paid for by the parties.

Boniface S. Emerengwa filed a lawsuit Dec. 4 in the Circuit Court of Fayette County against WOBO Used Motor Sales and Repairs Inc., doing business as WOBO Motor Sales International.

According to the complaint, on March 18, Emerengwa entered into a verbal contract with the defendant to purchase a 2010 Mercedes automobile and an oil recovery truck for $73,500.

Emerengwa claims after fully paying for the equipment in four installments, the defendant failed to deliver the equipment. He also claims that on Aug. 15, the defendant promised to pay $8,000 to reimburse him for shipping charges associated with the shipment of a backhoe that was previously purchased.

The complaint alleges the defendant has failed and refused to repay or refund the amount of the payments.

Emerengwa is seeking a judgment in the amount of $81,500, plus attorneys fees, court costs and interest. He is being represented by attorney James C. Blankenship III.
