Man says he was injured on faulty bulldozer

LOGAN -- A worker is suing his employer after he was injured while working with heavy equipment.


Kevin Lester filed a lawsuit Jan. 29 in Logan Circuit Court against Apogee Coal Company LLC, Patriot Coal Corp. and Cecil I. Walker Machinery Co., citing negligence and unsafe working conditions.

The lawsuit states Lester had been working with a Caterpillar D-10-T, which needed repairs. He told supervisors several times the machine wasn’t working correctly, according to the suit.

Lester was working with the machine May 15, when the dozer turned over and fell 20 feet down an embankment, the complaint states. Lester was pulled from the machine by fellow employees and is left seriously and permanently injured, according to the complaint.

Lester is seeking compensatory and punitive damages, pre-judgment and post-judgment interest, plus court costs. He is being represented by private attorney Stephen P. New.
