BECKLEY -- A woman is suing General Motors LLC and GM Financial for allegedly abusive and oppressive debt collection practices.
In her complaint filed Jan. 29 in Raleigh Circuit Court, Lisa M. Kincaid accuses GM of violating West Virginia's Consumer Credit and Protection Act.
Kincaid's filing states GM harassed her over a debt and placed frequent phone calls at unreasonable time of the day. She says GM used abusive, coercive and oppressive debt collection practices to purposely annoy her.
In addition to violating WVCCPA, Kincaid accuses GM of invading her privacy and violating the Telephone Harassment Statute.
Kincaid is seeking more than $75,000 in damages. She is being represented by attorney Ralph C. Young of Hamilton, Burgess, Young and Pollard. The case has been assigned to Circuit Judge Robert A. Burnside.
