BECKLEY -- Three Raleigh County men are suing two national banks, claiming harassment.
Christopher E. Burgess and Collis L. Bickford filed three separate lawsuits Jan. 31 and Feb. 3 in Raleigh Circuit Court against Credit One Bank N.A. and GE Capital Retail Bank, citing violations of Consumer Credit and Protection Act, Computer Crime and Abuse Act and Telephone Harassment Statute, as well as infliction of emotional distress and invasion of privacy.
Burgess and Bickford claim they received multiple phone calls from the defendants in order to annoy and harass them into paying debts owed the defendants. According to the claim, the defendants tried to collect the debts due in ways which are in direct violation of several laws put into place in the state of West Virginia.
Burgess and Bickford are seeking damages, attorney's fees and court costs. They are being represented by Fayetteville attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young and Pollard PLLC. The case has been assigned to Circuit Judges Robert A. Burnside and H. L. Kirkpatrick.
