HUNTINGTON -- A personal injury case where a shopper fell in a store has been removed from a circuit court to a district court.


A Notice of Removal in a case filed by Amanda Tolliver against Wal-Mart Stores Inc. was submitted on Feb. 24 to the United States District Court for the Southern District of West Virginia.

The notice said Tolliver was a patron in the Wal-Mart, on U.S. 60 in Huntington, Cabell County on Nov. 17, when she slipped on an unknown substance on the floor near the check out line and was injured.

The basis of removing it from Cabell Court to District Court is that the civil action is between citizens of different states and the amount in controversy exceeds $75,000.

Wal-Mart is asking the court assume full jurisdiction of the cause. Wal-Mart is represented by Billie Jo Streyle and MacCorkle Lavender P.L.L.C.
