Woman accuses state department of racial discrimination

CHARLESTON -- A woman is suing a juvenile correction facility and her supervisor on allegations she was passed over for a promotion because of her race.


Phylicia Barber filed a lawsuit Feb. 5 in Kanawha Circuit Court against the Division of Juvenile Services and supervisor Derek McKinney, citing civil rights violations.

The lawsuit states Barber applied for the position of Correctional Officer I at the facility in the summer of 2013. She was not selected even though she met all qualifications, the complaint states.

Barber is seeking compensatory damages for injuries and loss, punitive damages against McKinney, plus court costs.

She is being represented by Paul M. Stroebel of Stoebel & Johnson P.L.L.C.
