Rail contractor blamed for vehicle collision

MOOREFIELD -- A Grant county couple is suing after the wife sustained injury in a motor vehicle accident.


Nancy W. Dove and Gary L. Dove filed a lawsuit March 5 in Hardy Circuit Court against Amtrac Railroad Contractors of Maryland Inc. and Brent J. Robinson.

Amtrac is  It is not part of Amtrak, the publicly funded railroad service. Amtrac is a professional railroad contractor for the Short Line and other regional railroads.

The complaint states on June 7, 2012, Nancy Dove was driving south on North Main Street in Moorefield when her vehicle was struck in the rear by Robinson while he was operating a vehicle owned by Amtrac. The plaintiffs contend the truck Robinson was operating had previously experienced mechanical problems with its brakes.

The plaintiffs are seeking compensatory damages, punitive damages and costs.

They are being represented by J. David Judy III of Judy & Judy. The case has been assigned to Circuit Judge H. Charles Carl III.
