CHARLESTON -- A mother of two sons is suing, alleging her children have been subjected to abuse.
Amy Corder, individually and on behalf of her sons, Joshua Reed and Tyler Reed, filed a lawsuit March 11 in Kanawha Circuit Court against Child Protective Services of Wyoming County, a division the West Virginia Department of Health and Human Services, and Jonathan Reed, citing private child abuse and/or neglect, assault, battery, Fifth and Fourteenth Amendment violations and intentional misrepresentations.
The complaint states Amy Corder and Jonathan Reed were divorced on June 8, 2011, and Corder was established as the primary caretaker. On Aug. 1, 2011, Jonathan Reed filed a Petition for Contempt after Corder failed to provide him with required visitation, according to the complaint. The court document states at the contempt hearing, Jonathan Reed was awarded temporary, physical custody of the children.
Corder contends that on Aug. 31, 2011, she filed a complaint against Jonathan Reed alleging child abuse. The complaint states, Children Services of Washington County, Ohio, investigated the abuse allegations and testified at trial their investigation substantiated the abuse allegations. However, on Nov. 20, 2012, primary, residential custody was granted to Jonathan Reed, according to the complaint. The plaintiff alleges the Department of Health and Human Services previously admitted the children were abused, but when called to testify they concealed they believed the children were abused.
The plaintiffs are seeking an undisclosed amount in damages.
