Woman falls on bird bath display, sues Wal-Mart

MOOREFIELD -- Wal-Mart is sued after allegedly failing to keep their Moorefield store in a safe condition.

Theresa Shipe filed a lawsuit April 1 in Hardy Circuit Court against Wal-Mart Stores Inc., citing negligence.

The complaint states on April 3, 2012, Shipe was shopping at the Wal-Mart store at 11 Harness Road, Moorefield, when she tripped and fell on bird baths that were displayed along the walkway aisle.

The defendant was negligent and failed to keep the premises in a reasonably safe condition, according to the complaint.

Shipe is seeking an undisclosed amount in damages.

The plaintiff is being represented in the case by attorney Lawrence E. Sherman Jr. The case has been assigned to Circuit Judge H. Charles Carl.
