Couple sues trucking company after accident

FAYETTEVILLE -- A couple is suing a truck driver and the companies he works for after he collided with their vehicle, causing injuries.

James A. Murdock Jr. and Barbara A. Murdock filed a lawsuit April 2 in Fayette Circuit Court against David M. Smith, William Thomas Allen, William Thomas Allen Trucking, Utility Tractor Service Inc., doing business as UTS Leasing, UTS Leasing Inc. and UTSI Finance Inc., citing negligence.

The lawsuit states James Murdock was driving a Dodge Ram pickup truck on U.S. 19 in Mount Hope when Smith was driving a Kenworth truck trailer owned by William Thomas Allen or William Thomas Allen Trucking with a flatbed owned by UTS, UTS Leasing and UTSI Finance.

Smith collided with James Murdock, causing injures that required $6,007 in medical expenses, the complaint said. James Murdock will require more care and Barbara Murdock has been deprived of care, society and services of her husband, the complaint states.

The Murdocks are seeking damages in an amount justified by evidence and are demanding a jury trial.

They are being represented by Kevin B. Burgess of Hamilton, Burgess, Young & Pollard P.L.L.C. The case has been assigned to Circuit Judge John W. Hatcher.
