Putnam couple blames Roto Rooter for traffic accident

WINFIELD -- A Putnam County couple are suing over claims a collision on W.Va. 34 was caused by a Roto Rooter employee.

John and Brittany Davis filed a lawsuit May 2 in Putnam Circuit Court against Roto Rooter Plumbing Services and John V. Carr, citing negligence.

According to the complaint, John Davis was driving south on W.Va. 34 with Brittany Davis as a passenger on May 4, 2012, when Carr, driving a vehicle owned by Roto Rooter northbound, negligently turned into the plaintiffs' lane, causing injury to the plaintiffs.

Roto Rooter is accused of negligently entrusting its vehicle to employee Carr.

The plaintiffs are seeking damages in an amount to be specified later.

They are being represented in the case by attorney James M. Casey. The case has been assigned to Circuit Judge Phillip M. Stowers.
