Recycling company says bank won't reimburse forged checks

CHARLESTON -- A Kanawha County company is suing over claims a bank refuses to reimburse fraudulent checks it cashed.

J&D Recycling of West Virginia LLC filed a lawsuit May 23 in Kanawha Circuit Court against First Bank of Charleston Inc., citing breach of contract.

According to the complaint, from December to February a J&D Recycling employee altered and forged numerous checks which First Bank of Charleston Inc. cashed. J&D Recycling says the employee forging the checks was found and fired Feb. 12, a police report was filed and on Feb. 24, the defendant was informed of the police report and fraudulent checks totaling to more than $9,000, for which the bank has refused to reimburse J&D Recycling.

First Bank of Charleston is accused of breach of implied and specific contracts, failure to act in good faith, gross negligence, reckless conduct and fraud.

J&D Recycling is seeking the $9,000 reimbursed plus $10,000 in damages and attorney's fees.

It is being represented in the case by attorney Jennifer N. Taylor. The case has been assigned to Circuit Judge Charles E. King.
