Couple accuses Beneficial of predatory lending

CHARLESTON -- A Kanawha County couple are suing over claims they were the victims of predatory lending.

Richard G. Dunn Sr. and Susan K. Dunn filed a lawsuit May 27 in Kanawha Circuit Court against Beneficial West Virginia Inc., citing predatory lending.

According to the complaint, Beneficial West Virginia placed the Dunns in a loan for $94,000 when the market value was $54,000, and named Beneficial's own manager as the "neutral" trustee. Beneficial West Virginia is accused of illegal predatory loans, unconscionable inducement, and fraud.

The Dunns are seeking the loans be deemed void, damages and attorney's fees.

They are being represented in the case by attorney Daniel F. Hedges of Mountain State Justice Inc. The case has been assigned to Circuit Judge Carrie L. Webster.
