Couple blames roofer for leaks

NEW CUMBERLAND -- A couple are suing a roofer after their roof started leaking after only two years.

Willard M. and Phyllis R. Swan filed a lawsuit July 9 in Hancock Circuit Court against Valley Roofing of E.L. Inc., citing breach of contract and negligence.

The lawsuit states the Swans and Valley Roofing entered into a contract April 14, 2011, and the Swans paid $10,330 on July 25, 2011, for a new roof at their property at 101 S. Chester St., New Cumberland. The Swans discovered the roof was leaking in December 2013 and an inspection determined problems existed in the construction including improperly installed shingles, missing shingles, improperly tarred roof, improper flashing, failure to install underlayment and failure to inspect the roof foundation, according to the complaint.

The Swans are seeking damages in excess of jurisdictional limits.

They are represented by M. Eric Frankovitch of Frankovitch, Anetakis, Colantonio & Simon of Weirton. The case has been assigned to Circuit Judge Ronald E. Wilson.
