FAYETTEVILLE -- A man is suing over claims his former employer failed to pay his final wages in a timely manner.
Kermit W. Tuttle filed a lawsuit July 9 in Fayette Circuit Court against EMS Transport LLC.
According to the complaint, Tuttle was employed by EMS Transport at its Gauley Bridge location from Feb. 20 until his employment was terminated March 21, but EMS Transport failed to pay his wages by the next payday or within four days, which is a violation of the West Virginia Wage Payment and Collection Act.
Tuttle is seeking the wages, liquidated damages and attorney's fees.
He is being represented in the case by attorneys J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices and G. Patrick Jacobs of Jacobs Law Office in Charleston. The case has been assigned to Circuit Judge John W. Hatcher.
