CHARLESTON -- A man has filed a putative class action lawsuit, alleging a failure to timely pay employees after they were terminated.
Shawn R. Carter filed suit July 15 in Kanawha Circuit Court against United Dairy Inc.
According to the complaint, United Dairy failed to pay its discharged employees all due wages within the time constraints mandated by West Virginia law. Carter was involuntarily terminated Dec. 17, but was not paid all wages owed to him until after Dec. 27, according to the complaint.
Carter alleges United Dairy violated the Wage Payment and Collection Act.
Carter is seeking an unspecified judgment, plus general compensatory damages, pre- and post-judgment interest, attorneys’ fees, injunctive relief and other relief the court deems just.
He is being represented by attorneys Todd S. Bailess and Joy B. Mega of Bailess Law in Charleston and Rodney A. Smith and Jonathan R. Marshall of Bailey and Glasser in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
