Putnam man sues hauler, driver's estate for wreck injuries

CHARLESTON -- A Putnam County man is suing over claims he was injured in a collision in Kanawha County.

Michael Powell filed a lawsuit Aug. 12 in Kanawha Circuit Court against YRC Worldwide Inc., YRC Inc., doing business as YRC Freight, and the estate of John C. Miller, citing negligence.

According to the complaint, Powell was driving a tractor with a trailer on Interstate 64 near Cross Lanes on Dec. 24 when he was rear-ended by a tractor and trailer driven by Miller for YRC. The complaint states Miller was killed in the collision, and Powell sustained injuries.

Powell is seeking general, special and punitive damages.

He is being represented in the case by attorney Christopher J. Heavens of Heavens Law Firm P.C. in Charleston. The case has been assigned to Circuit Judge Louis H. Bloom.
